    Abstract

    This study addresses the topic of The Phenomenon of Major Irrevocable Divorce (Talaaq Bai’n) in the Kingdom of Saudi Arabia: A Field Study in Holy City of Makkah.The research, as the first objective and academic study in this issue, aims to study the factors and reasons that led to the increasing rates of divorce in the Kingdom in general and the Holy City of Makkah in particular in the present and past. It also aims to clarify the wise ways to solve the problems of divorce in Makkah, suggesting some suitable Islamic measures to limit the rates of divorce. All that was based on academic research comprising three methodologies: the qualitative descriptive methodology which studies the reality of divorce cases, and then analyzes them to come up with remedies for the reasons of divorce; the inductive methodology by collecting the texts related to the topic and the ancient and current scholars’ opinions so that I reach the rulings about divorce in Islam; and the analytical methodology by studying the texts in the Islamic Legislation for finding the best solution to increasing rates of divorce and their results such as family breakdown and many serious social problems.The fifth chapter includes a field study which clarifies, analyzes and comments on the topic by using the tool of interviewing a group of specialists from Makkah to know the most important reasons for increasing the rates of divorce. Eventually, the sixth Chapter of this study tackles the most significant legislative, legal, social and educational measures to eradicate the phenomenon of the increasing rates of divorce and designing a group of solutions and results. Among the most important results which the study reached at are the first reason for divorces in the Kingdom of Saudi Arabia is the disobedience of the couple against the legal methodology in choosing the appropriate partner. The second reason is the negative impacts of divorce on the Islamic communities among which is the Saudi community in general and the Makkan community in particular, for example vi the family breakdown and loss of children, the abundance of juvenile delinquency, sentimental dryness, and the weakness of study levels for divorced parents’ children. In addition, the divorce of the parents is most factor for juvenile delinquents and their committing crimes because of the absence of the joint role in caring for and attending the children and so on.
